Student Journalists Scolded for Recording Public Meeting

When student journalist Benjamin Guhin attempted to record a Student Life Council Meeting at Fordham University, he didn’t think he was doing anything wrong. Rodgers directed a graduate assistant attempt to delete the tape’s contents. Dean Rodgers and SLC leaders claim they were open to the idea of students tape-recording their meetings, but that the student needed to ask first. According to New York State law, individuals who are party to a conversation may record it without informing the other parties that they are doing so. Further, in Shuldiner v. City University of New York, the New York State Supreme Court decided that, due to the “public nature” of the College of Staten Island Association’s meetings, attendees had a legal right to tape record them. Still, professor of Communication at Fordham, Arthur Hayes, says the right to tape record is not a black and white issue when at a private university. "The general and short answer is: You have only the rights university officials wish to recognize," Hayes said. "Fordham is a private institution. Generally, tape recording would be allowed in public forums. But that's not an absolute right."
